User Agreement
This User Agreement ("Agreement") governs your access to and use of the contrailbags.com website ("Site") and all products, services, and content offered by Contrail ("Contrail," "we," "us," or "our"). By accessing or using the Site, you ("User" or "you") agree to be bound by this Agreement. If you do not agree to these terms, do not access or use the Site.
Acceptance of terms
By accessing, browsing, registering on, or purchasing from the Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement and by our Privacy Policy, which is incorporated herein by reference. This Agreement applies to all Users of the Site.
Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to place an order or create an account. By using the Site, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to this Agreement.
Account registration
Certain features of the Site may require you to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
Orders and payment
All orders placed through the Site are offers to purchase and are subject to acceptance by Contrail. We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, errors in pricing or product information, or product unavailability. You agree to provide current, complete, and accurate purchase and account information for all purchases. Payment must be received and authorized before an order is processed and shipped.
Pricing and product availability
All prices are listed in the applicable currency and are subject to change without notice. We make reasonable efforts to display accurate pricing and product information, but errors may occur. In the event a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and payment processed. Product availability is not guaranteed and may change at any time.
Shipping and delivery
Shipping timeframes provided at checkout or elsewhere on the Site are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our reasonable control.
Returns and refunds
Returns, exchanges, and refunds are governed by our Return Policy, which is available on the Site and incorporated into this Agreement by reference. By placing an order, you agree to the terms of that policy. Where no separate Return Policy is posted, returns are accepted at our sole discretion.
Intellectual property
All content on the Site, including text, graphics, logos, images, product designs, photographs, and software, is the property of Contrail or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on the Site without our prior written permission. The Contrail name, logo, and related marks are trademarks of Contrail and may not be used without authorization.
User content
If you submit reviews, comments, images, or other content to the Site, you grant Contrail a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and display that content in connection with our business. You represent that you own or control all rights to the content you submit and that it does not violate this Agreement or any third-party rights. We reserve the right to remove any User content at our discretion.
Prohibited uses
You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. Prohibited activities include, but are not limited to: attempting to gain unauthorized access to any portion of the Site or its systems; transmitting viruses or malicious code; using automated means to scrape, harvest, or collect data; interfering with other Users' use of the Site; submitting false or misleading information; and using the Site to infringe the intellectual property or other rights of any party.
Disclaimer of warranties
The Site and all products and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Contrail does not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Contrail and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Site or any products purchased through it. In no event shall our total liability to you for all claims exceed the amount you paid to Contrail for the product or service giving rise to the claim. Some jurisdictions do not allow the limitation of liability, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Contrail and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of this Agreement, or your violation of any rights of a third party.
Third-party links
The Site may contain links to third-party websites or services that are not owned or controlled by Contrail. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to the terms of those sites.
Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to the Site or your account at any time, with or without notice, for conduct that we believe violates this Agreement or is otherwise harmful to Contrail or other Users. Provisions of this Agreement that by their nature should survive termination shall survive.
Governing law
This Agreement and any dispute arising out of or relating to it or the Site shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
Changes to this agreement
Contrail reserves the right to modify or update this Agreement at any time at its sole discretion. Changes become effective upon posting to the Site. It is your responsibility to review this Agreement periodically. Your continued use of the Site following the posting of any changes constitutes your acceptance of those changes.
Severability
If any provision of this Agreement is found to be unlawful, void, or unenforceable, that provision shall be severable from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
Entire agreement
This Agreement, together with our Privacy Policy and any other policies posted on the Site, constitutes the entire agreement between you and Contrail regarding your use of the Site and supersedes any prior agreements.
